(“The Tyre Mall”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) govern your use of our website, purchase of products, and related services. By accessing or purchasing from our site, you agree to be bound by these Terms, as well as our Privacy Policy.

1. General Use of Website

The website is intended for personal, non-commercial use only.

By using this site, you confirm that you are at least 18 years old and legally capable of entering into binding agreements.

We reserve the right to update, amend, or withdraw parts of the website and these Terms at any time.

2. Product Availability

All products listed are subject to availability.

Adding products to your cart does not guarantee availability or constitute a binding sale.

In the event of stock shortages or discontinuations, we reserve the right to cancel the order and issue a full refund to the original payment method.

3. Pricing & Errors

All prices are listed in South African Rand (ZAR) and include VAT unless stated otherwise.

Prices displayed include tyres only, unless otherwise specified (fitment, alignment, balancing, and other services may be charged separately).

We make every effort to ensure that pricing is correct. However, in the event of incorrect pricing due to typographical error, technical issue, or supplier change:

We are not obliged to honour the incorrect price.

We reserve the right to cancel the order, refund the payment in full, and notify you of the error.

Prices are subject to change at any time without notice.

4. Orders & Payment

Placing an order on our website constitutes an “offer to purchase”. A binding sale occurs only once we issue a written/email confirmation.

Payment must be made via the approved methods displayed at checkout (e.g., credit/debit card, EFT, instant payment gateways).

Orders not paid within 7 calendar days may be automatically cancelled.

We do not accept cash deposits, cheques, or foreign currency transfers unless expressly agreed.

5. Delivery & Collection

Delivery is available within the Republic of South Africa only.

Delivery timelines are estimates (typically 3–5 business days) and may vary due to courier delays or stock location.

We are not liable for delays outside our reasonable control.

If delivery cannot be completed due to incorrect address or absence of the customer, additional charges may apply for re-delivery.

Risk of loss or damage passes to you upon delivery. Ownership remains with The Tyre Mall until payment is received in full.

6. Fitment & Installation

Customers are responsible for ensuring that tyres purchased are compatible with their vehicle.

We recommend professional fitment at approved fitment centres.

Incorrect fitment, neglect, misuse, or modification will void warranties.

7. Returns, Cancellations & Refunds

Cooling-Off Period: Customers may cancel online purchases within 7 business days of delivery, provided tyres are unfitted, unused, and in original packaging.

Refunds will exclude courier/handling fees and will be processed within 15 business days.

If goods are defective due to a manufacturing fault, you must notify us in writing within 7 days of delivery and return the tyres (at your cost) for inspection.

If the defect is confirmed, we will repair, replace, or refund in line with the Consumer Protection Act (CPA).

Refunds will be made via the original method of payment only.

8. Warranty

All products carry the manufacturer’s warranty.

Warranty claims cover manufacturing defects only and exclude wear-and-tear, road hazard damage (e.g., punctures, potholes, impact), incorrect inflation, alignment issues, or misuse.

Warranty claims must be submitted with proof of purchase and evidence of professional fitment.

9. Limitation of Liability

The Tyre Mall is not the manufacturer of the tyres and does not assume responsibility for defects outside the scope of the manufacturer’s warranty.

To the maximum extent permitted by law, we disclaim liability for indirect, incidental, or consequential damages (including loss of profit, business interruption, or personal injury) arising from use of our products or services.

10. Incorrect or Fraudulent Use

The Tyre Mall reserves the right to cancel any order suspected of being fraudulent or in violation of these Terms.

We may refuse service, terminate accounts, or cancel orders at our sole discretion.

11. Intellectual Property

All website content, including text, images, logos, product data, and graphics, is owned by or licensed to The Tyre Mall.

No content may be copied, reproduced, or redistributed without our prior written consent.

12. Privacy & Data Protection

Your personal information will be handled in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA).

By transacting with us, you consent to the collection, storage, and processing of your data for order fulfillment and marketing purposes.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa.

Any disputes shall first be referred to mediation or arbitration in Johannesburg, South Africa.

The Tyre Mall reserves the right to pursue legal remedies in a competent court if necessary.

14. Radar Protect – 12‑Month Road Hazard Protection

14.1 Selected Radar brand tyres sold by The Tyre Mall include Radar Protect Road Hazard Protection (“Radar Protect”). Radar Protect is a goodwill replacement programme provided by Radar Tyres and/or its authorised distributor and is subject to their terms and conditions, which may change from time to time.

14.2 Radar Protect applies only to specific eligible Radar patterns and sizes. Only products clearly indicated on our website as including “Radar Protect – 12‑Month Road Hazard Protection” are covered.

14.3 Coverage Period
Radar Protect cover for an eligible tyre is valid until the earlier of:
(a) twelve (12) months from the original date of purchase; or
(b) the first 4 mm of tread wear from the original usable tread depth,
whichever occurs first.

14.4 Scope of Cover
Subject to approval by Radar Tyres and/or its authorised distributor, Radar Protect covers non‑repairable damage to an eligible tyre caused by road hazards such as cuts, punctures, bruises, snags and impact breaks arising from objects including, but not limited to, nails, glass, potholes and road debris.

14.5 Exclusions
Radar Protect does not cover, amongst other things:
(a) normal tread wear or tyres worn beyond 4 mm of the original usable tread;
(b) tyres that can be repaired in accordance with recognised tyre repair standards;
(c) damage caused by incorrect inflation, overloading, lack of rotation, or improper maintenance;
(d) damage caused by vehicle mechanical or alignment defects;
(e) damage arising from racing, competition use, abuse, negligent driving, burnouts or spinning;
(f) damage resulting from accidents, collisions, vandalism, fire, chemical exposure or improper storage;
(g) tyres used for commercial, fleet, rental, emergency or competition purposes;
(h) tyres purchased from unauthorised or non‑participating retailers;
(i) tyres transferred from the vehicle on which they were originally fitted.

14.6 Customer Responsibilities and Claim Process
To be eligible for Radar Protect, you must:
(a) retain the original purchase invoice from The Tyre Mall;
(b) ensure that the tyres are fitted to the vehicle specified on the invoice and are the correct size and load rating for that vehicle;
(c) maintain the tyres in accordance with the vehicle and tyre manufacturer’s recommendations.

To submit a claim, you must contact us and provide the original invoice, a completed claim form and the required photographs and information as detailed on our Radar Protect information page. The Tyre Mall will forward your claim to Radar Tyres and/or its authorised distributor for assessment.

14.7 Replacement and Costs
If a claim is approved under Radar Protect, the damaged tyre will be replaced with an equivalent Radar tyre of the same range or of similar construction and quality. Where a higher‑priced tyre is selected, you will be responsible for paying any price difference.

You are responsible for all associated costs including, without limitation, fitting, balancing, alignment, consumables, disposal fees, shipping and applicable taxes.

14.8 Limitation of Liability
Radar Protect is administered by Radar Tyres and/or its authorised distributor. The Tyre Mall’s role is limited to facilitating the submission of claims on your behalf. The Tyre Mall does not determine claim outcomes and shall not be liable for any claim that is declined. Nothing in this clause limits any rights you may have under applicable consumer protection laws.
